Colorado Events LLC, doing business as Cbadge, and its affiliates (collectively referred to in this document as “we,” “us” or “Company”) is strongly committed to respecting and protecting your privacy. Please carefully read the following Privacy Policy (“Policy”). In order to ensure your privacy, information the Company collects from its clients and visitors to its Web site located at cbadge.com (the “Site”) is used only in the manner and for the purposes described in this Policy. By continuing to use this Site and/or the Services provided by this Site (as defined in the Site’s Terms and Conditions “Terms”), you agree to be bound by this Policy and you acknowledge that you have read and understood these terms.

The purpose of this Policy is to explain the types of information that the Company collects, what we do with that information, and with whom the Company shares this information. Anyone who provides personally identifiable information (“Personal Information”) or any other information to the Company consents to the collection, use and disclosure of such information under the terms of this Policy.

This Policy applies to both our clients to whom we provide services (“Clients”) and to those individuals who browse and use our Site (“Visitors”). The following articles make up our Privacy Policy.

1. Our Services

The Company is committed to assisting Clients with the obtaining of background reports, including investigative reports via the Services. The Company collects information from our Clients, employees, vendors, agents, and stakeholders that assists us in providing the Services. The information that is provided to the Company by Clients is used by the Company only to conduct work for its Clients and for no other purpose. Unless mandated by law or valid court order this information is only shared with our Clients or with our vendors or other affiliates who have a need to know such information in order to fulfill the Services.

2. Information Collected by the Company

The Company may collect any Personal Information that is provided to us by our Clients, our Clients’ Employees, Visitors, or third-parties, such as public or private records or personal interview information or via third-party partners and their databases. This includes, without limitation, name, phone number, mailing address, email address, or any other Personal Information that is provided to us in connection with the Site or the use of our Services.

Additionally, for the Services and other specific tasks, we may obtain Personal Information such as dates of birth, bank account numbers, civil and/or criminal background information, government issued identification numbers, protected class information, internet browsing history, professional or educational history information, inferences draw from Personal Information, and other information permitted by the Fair Credit Reporting Act.

3. Cookies

When our Clients use our Site, we collect certain internet and network information, including cookies. For more information on the use of cookies, see our Cookie Consent Policy.

4. How the Company Uses Information

We use Personal Information obtained from our Clients for the Services and/or as permitted by law. Such usage includes, but is not limited to, requesting, completing, analyzing and producing background reports, communicating with you about the Services, our internal operations, such as billing and other content modification, as required by law in order to comply with any investigation and/or other governmental mandate, to ensure adequate security and to protect against unauthorized access, including the prevention and/or detection of fraud, quality assurance, for marketing and/or research purposes, or as otherwise permitted by law. To the extent your Personal Information or other data is anonymized by us, we may use such information/data without limitation.

When visitors to the Site request that the Company contact them, the Company’s Site registration form requires those visitors to provide specific contact information such as name and email address. The Company uses the contact information from the registration form to send the individual information about us. The Company also uses Personal Information obtained from visitors to our Site to respond to questions, comments and other requests from these individuals, including responding to inquiries about employment opportunities.

We require Clients to establish an account for the Services which will permit us to communicate electronically via email, text, or otherwise as designated. By using the Services you consent to and agree to the Terms and this Policy, and you represent and warrant that the information provided in and via your account is true and accurate, and you further consent to contact via electronic communication.

Pursuant to the Electronic Signatures in Global and National Commerce Act (“E-Sign Act”), we are required to provide you the following disclosures prior to your agreement to receiving your consent to participate in electronic signatures/disclosures. Accordingly, please read the following carefully. Please indicate your acknowledgement and consent to participation in electronic signatures/disclosures by checking the box at the end of these provisions:

We intend on providing all information relating to the Services, including legal disclosures and deliverables, to you via electronic means. There are no fees associated with your request. You must specifically identify the items you desire to have paper copies of and provide your name and mailing address. You have the right to withdraw consent from receiving information electronically; however, such withdrawal may result in the termination of Services, and if any work has been undertaken for the Services, you shall forfeit any right to a refund, unless otherwise prohibited by law.

The consent to receive electronic information applies to all aspects of our provision of Services.

5. Sharing Personal Information with Others

We do not disclose, sell, share, trade or give away an individual’s Personal Information to third parties, except under one or more of the following circumstances:

Consent: If the individual has consented to the disclosure of his or her Personal Information, the Company may share such Personal Information with others, including, potentially, vendors of Company in order to facilitate the Services. In order to provide the Services, we may need to share your information with affiliates, partners, service providers, or governmental entities.

Protection of the Company and Others: We may disclose Personal Information about you to others: (i) if we have a good faith belief that we are required or permitted to do so by law or legal process; (ii) in connection with legal or administrative proceedings; (iii) to protect the rights, reputation, property or safety of the Company or others; (iv) to defend or enforce the Company’s rights or our Clients’ obligations; or (v) if the disclosure is required by mandatory professional standards.

Business Transfers: In the event that the Company decides to sell all or part of its stock or assets or merge its Company, it reserves the right to include Personal Information among the assets transferred to the acquiring or surviving company. It is the Company’s practice to seek appropriate protection for Personal Information in these types of transactions.

6. Your Choices with Respect to Personal Information

Certain jurisdictions (such as the European Union) provide specific statutory and regulatory rights with regard to your Personal Information. To the extent you live within such a jurisdiction, that jurisdiction’s laws and regulations shall apply.  To the extent you do not live within such a jurisdiction, the use of your Personal Information may be managed as follows:

You may have the right to request access to your Personal Information, correct your Personal Information, and (potentially) deletion of your Personal Information. To request access, correction, or deletion of your Personal Information held by Cbadge (as may be permitted by law), you may request the same via your Candidate Portal or email us at support@Cbadge.com. Before the Company is able to provide you with any information or correct any inaccuracies, however, we may ask you to verify your identity and to provide other details, including Personal Information, to help us to respond to your request.

Cbadge is governed by the Fair Credit Reporting Act which pre-empts the California Consumer Privacy Act, California Privacy Rights Act, Virginia Consumer Data Protection Act, and the Colorado Privacy Act. Accordingly, unless otherwise required by law, we comply with the Fair Credit Reporting Act when dealing with your Personal Information and responding to inquiries regarding access, correction, or deletion.

7. Linked Web Sites

As a service to our Clients and visitors, we may provide hyperlinks to valuable resources that are related to the products and services that we provide or may recommend. These hyperlinks, which are highlighted words or pictures within a hypertext document that may, when clicked, take you to another place within the document, to another document altogether, or to a third-party Web site not controlled by the Company. Such hyperlinked, third-party Web sites may collect and disclose information in a manner that is different from this Site. The Company is not responsible for the collection, use, or disclosure of information collected through these third-party Web sites, and the Company expressly disclaims any and all liability related to such collection, use, or disclosure.

8. Children

We do not sell products or services for purchase by children under the age of eighteen (“Minors”). The Company does not knowingly solicit or collect Personal Information from Minors, and we will not knowingly link to any third-party Web site that solicits or collects Personal Information from Minors. If you believe that a Minor has disclosed Personal Information to us or that we have linked to such a third-party Web site, please contact us at support@Cbadge.com.

9. Security and Protection of Data Collected by Us

The Site maintained for our Clients have security measures in place to protect the loss, misuse and alteration of the information under our control. The Company has implemented various physical, electronic, and managerial measures, including education and training of our personnel, to provide Personal Information with reasonable protection from accidental loss or destruction, improper use, alteration, or disclosure. The Company has invested and deployed a wide variety of technology and security features to ensure the privacy of Personal Information that is collected by the Company through its services and via the Site. In addition, the Company has implemented strict operational guidelines to safeguard privacy of data we collect at every level of our organization.

The Company will continue to revise policies and implement additional security features as new technologies become available. Unfortunately, no system is perfect; therefore, the Company makes no representations or warranties with regard to the sufficiency of these security measures. The Company shall not be responsible for any actual or consequential damages (or any other damages or liability of any kind whatsoever) that result from a lapse in compliance with this Policy because of a security breach or technical malfunction.

10. International Transfers of Personal Information

Permitted transfers of information, including Personal Information, either to third parties or within the Company, include the transfer of data from one jurisdiction to another, such as transfers to and from the United States of America. Because privacy laws vary from one jurisdiction to another, Personal Information may be transferred to a jurisdiction where the laws provide less or different protection than the jurisdiction in which the information originated. We will always handle your Personal Information as described in this Policy.

From time to time, the Company may update, modify or change this Policy. When this occurs, its new privacy policy will be posted on the Site. You should check the Site periodically to review the most recent Privacy Policy.
